As we are going to celebrate our 65th republic
day, so this is important to discuss the constitutional right in the field of
owing real estate property. In India the property right is different in
different parts of India. If we talk about Jammu and Kashmir then we have different
right for buying immovable property. There are some tribal state in India and
these states have their own law in buying property. But large part of the
region of India have same law. The outsiders are getting some problem to buy
the immovable property in many states of India. In the following lines we are
going to discuss why some of the state have different land transfer policy. To
save the rights of the people in some states no outsiders can buy the land from
the original inhabitants. This regions belong to tribal states. This kinds of
law have saved the people from money-lenders and middle men. But in the long
run these regions are less developed than other parts of India. Poverty and
malnutrition are major problems in these regions.
There are some parts of India which have followed the norms
of Globalization totally and became one of the most developed region of India.
In these regions any body can buy property and enjoy their life fully. These
regions are the major zones where foreign direct investment concentrated.
Delhi-NCR is considered on e of the prime region where NRIs invest their money
in new residential and commercial properties. In last 10 years the development and
growth of Gurgaon and Noida reached on its top level and became the top
priority region among foreign investors and MNCs. Sikka Kaamya Greens Noida Extension having high demand by outside investors. These all facts symbolizing the
open market policy of this region which are not available in many parts of
India. This kinds of difference in basic rules are bringing huge economic
disparity in India and which ultimately bring the huge labor class people.
Sometimes some of the sociologists are viewing that India is the land of labors
and elite class.
